Can a Nursing Home, Assisted Living Resident Refuse the COVID Vaccine?

vaccineVaccines are always controversial.  For many of us, we view our right to receive a vaccine – or refuse it – to be similar to a fundamental human right.

Many of our families are concerned their loved ones will be required to get a COVID-19 vaccination once it become available, or be forced to leave their skilled nursing or assisted living placement.

I’m happy to tell you the facilities are not allowed, under federal law, to require your loved one to get a COVID-19 vaccination.

In fact, the Centers for Medicare and Medicaid currently say it is the resident’s choice whether or not they receive a vaccine.
