The NJ Division of Motor Vehicles is the state agency responsible for regulating driver’s licenses, including commercial drivers licenses (“CDL”) and provisional licenses. Individuals often do not know their rights when it comes to actions taken by the State Division of Motor Vehicles (DMV) to suspend a license or propose to take some other action with respect to licensing. For example, an individual can be served with a notice of proposed suspension from the DMV even though they were already found not guilty of the charge which caused them to be charged with driving while on the suspended list. Even if the violation was dismissed, the DMV still has notice that the driver was operating on a roadway or operating his or her vehicle and administratively can take action against the driver. More often however, individuals are receiving a notice of suspension because they have accumulated more than 12 points on their license, or failed to complete a point reduction program to keep their license, or were involved in some incident while operation of a vehicle (e.g. high speed, death, serious injury, etc.).
